1.2 The buyer or customer

Any person who uses the Webshop service, i.e. registers on the www………………..internetes website and places orders or makes purchases through this platform.

1.3 Delivery provider details

1.3.1 [Courier Company] delivers our goods under the terms of a contract concluded with them, in accordance with their own general terms and conditions, at the rates available under the “Shipping/Payment” menu item.

2. Purpose of the webshop terms and conditions

[Webshop Ltd.] has issued these Webshop Terms and Conditions in order to set out in detail the conditions relating to the Webshop service and its use, as well as the rights and obligations of the service provider and the buyer, and other material circumstances connected with the Webshop service.

The Webshop Terms and Conditions contain the general terms of the legal relationship established between [Webshop Ltd.] and the buyer entering into a contractual relationship with it. With regard to matters not regulated herein, the currently applicable Hungarian laws and official regulations governing the service provider’s webshop activities, as well as the provisions of the Civil Code, shall apply without any specific stipulation.

2.1 Publication of the webshop terms and conditions

Acceptance of the Webshop Terms and Conditions by the buyer is a prerequisite for using the Webshop service. The buyer is deemed to have accepted the terms if they use the service, i.e. register.

2.2 Scope of the webshop terms and conditions

[Webshop Ltd.] reserves the right to amend the Webshop Terms and Conditions in part or in whole at any time. The Webshop Terms and Conditions and any amendments thereto shall take effect upon publication. The Webshop Terms and Conditions shall remain in force for as long as the Webshop service provider provides the Webshop service, and with respect to matters that commenced before termination but have not yet been concluded, until their conclusion.

3. The Webshop service

[Webshop Ltd.] provides the Webshop service to the buyer under the following conditions.

3.1 Territorial scope of the webshop service

The data network management interface maintained by the Webshop service provider is accessible both domestically and from abroad, due to the nature of the internet. However, [Webshop Ltd.] only accepts orders addressed to destinations within the territory of Hungary. Delivery to postal or other addresses outside the territory of Hungary is therefore not possible.

By accepting these GTC, the buyer has entrusted [Webshop Ltd.] with the storage, archiving, and processing of data. [Webshop Ltd.] undertakes to handle the data confidentially, shall not disclose it to third parties on the basis of the existing legal relationship, and shall store it securely on its servers.

4. Formation and modification of the webshop contract

4.1 General characteristics

The contract is formed by registration on the service provider’s website and acceptance of these terms and conditions. Registration is a prerequisite for purchasing in the Webshop. Orders are placed when the buyer approves the order in its final form. [Webshop Ltd.] reserves the right to delete registration data and declare orders placed with such data invalid if, upon receipt of orders, the authenticity of the registration data is questionable or unclear.

4.2 Registration

During webshop registration, the buyer gains the ability to place orders after providing their details. The buyer may browse the product range freely without logging in and add items to their cart. The buyer can log into the store with their username and password, after which they can purchase the items collected in their cart while not logged in. The purchase is completed using the designated button on the website.

4.3 Modification and cancellation of orders

In accordance with Act CVIII of 2001, the webshop software immediately sends a confirmation of the order to the customer upon placing the order. If this confirmation does not reach the customer within 48 hours, the customer’s binding offer shall cease to apply. [Webshop Ltd.] allows the customer to withdraw their order electronically up until the start of order fulfilment. When fulfilment begins, the customer receives an email notification, after which the order may only be withdrawn in person (via customer service contact details), which [Webshop Ltd.] customer service may accept or refuse according to the following guidelines:

In the case of cash-on-delivery by courier, it may be accepted for orders that have not yet been handed over to the courier. If the courier has already collected the goods from [Webshop Ltd.] for delivery, the customer may exercise this right at the time of delivery.

In the case of payment by bank card, the withdrawal of the order may be accepted in accordance with the rules for cash payment, with the proviso that the transferred amount will be refunded within 30 days, and the costs incurred during bank transactions shall in this case be charged to the customer, deducted from the refunded amount.

4.4 Payment terms

The buyer pays for the purchased goods and services either electronically (by bank card) at the time of placing the order, in cash to the courier upon receipt of the goods, or by direct bank transfer to [Webshop Ltd.]’s bank account. [Webshop Ltd.] issues an invoice upon receipt of cash payment. The buyer may accept all items of the order together or refuse to accept the entire order. If the customer refuses to accept the order, [Webshop Ltd.] reserves the right to cancel the customer’s registration and invalidate any orders that may have been placed in the meantime, based on individual assessment.

[Webshop Ltd.] does not charge a fee for the use of a given payment method that exceeds the costs it has incurred in connection with that payment method.

4.5 Data Transfer Declaration

I acknowledge that the following personal data stored in the user database of Pizza-Workshop (data controller), located at 3711 Szirmabesenyő, Állomás utca 86, on the website https://pizza-workshop.com/, will be transferred to SimplePay Plc. as the data processor. The scope of the data transferred by the data controller includes: name, email address, and billing information.

4.6 In case of unsuccessful delivery

Under standard delivery terms, the carrier will attempt delivery of the ordered goods on two occasions. The customer then has an additional 5 days to collect the goods at the designated postal collection point. If the customer fails to do so, the order is declared void by the seller and deleted once the goods are returned.

Customer service can provide information regarding any questions related to your order.

5. Rights and obligations of the buyer

5.1 Right of withdrawal

The buyer has the right to withdraw the ordered product from the service provider within 14 days of receipt, and to return it to the service provider in full within 14 days of the withdrawal. In accordance with Government Decree 45/2014 (II. 26.), the cost of return shipping shall be borne by the buyer. To avoid disputes, a video recording is made of the unpacking of returned packages. The seller is obliged to refund the purchase price of the goods, less any verifiably incurred costs, within 30 days of receiving the package. The right of withdrawal also applies during the period between conclusion of the contract and receipt of the product. In the event of withdrawal, the service provider is not obliged to reimburse the consumer for additional costs arising from premium delivery, only the standard delivery fee.

If withdrawal from the contract is not possible for a particular product due to its nature, this will be specifically indicated in the product description.

A recommended sample withdrawal declaration is attached. The use of a text other than the recommended sample does not mean that the withdrawal is invalid: the service provider considers the withdrawal valid if the intention to withdraw is clear and unambiguous from the buyer’s declaration, and withdrawal is possible for the product due to its nature.

5.2 [Webshop Ltd.] possible damages

If it is presumed that returned goods have been damaged as a result of improper use, [Webshop Ltd.] may, in accordance with the aforementioned decree, claim compensation from the customer for the resulting depreciation in value. The parties mutually accept the video recording made by the seller upon unpacking the goods as evidence of damage to the package.

5.3 Warranty

The seller’s liability for warranty and guarantee is governed by the provisions of the Civil Code and Government Decree No. 151/2003 (IX.22.).

5.4. After-sales services

Beyond customer service and warranty, [Webshop Ltd.] undertakes any additional post-sale service (e.g. non-warranty repair) under a separate, individual contract.

[Webshop Ltd.] has not drawn up a separate code of ethics (based on the option under the Act on the Prohibition of Unfair Commercial Practices against Consumers).

During registration required to use the service, [Webshop Ltd.] records the following data about buyers: data required for identification of the buyer: the buyer’s username, password (one-way encrypted) and email address. Name, address, and contact telephone number. For the purpose of delivering ordered goods, [Webshop Ltd.] makes the following data available to the carrier or the carrier’s representative: time of order, name of recipient (from delivery address), company name (from delivery address), full delivery address, order total, order number, customer phone number and other contact details.

6.2 Modification of personal data

The buyer may change or delete their provided personal data at any time via the Webshop’s user interface. The following data is exempt from deletion:

The buyer may request deletion of their registration at info@webaruhazkft.hu or by calling customer service. The phone number is not a premium-rate number.

7. Closing provisions

7.1. Provisions relating to contracts between remote parties

No written contract is drawn up regarding these terms and conditions, nor is it filed by [Webshop Ltd.]. Exceptions may apply to customers with whom the majority of purchasing transactions are not conducted electronically.

7.2. Termination of the legal relationship

The Webshop Terms and Conditions shall remain in force for as long as the Webshop service provider provides the Webshop service, and with respect to matters that commenced before termination but have not yet been concluded, until their conclusion. The buyer may request immediate termination of the contract at any time, provided that no transaction is in progress and neither party has any outstanding claim. Upon verification of identity, this will be acknowledged and the user’s access to the store will be terminated by deletion of their registration.

[Webshop Ltd.] reserves the right to unilaterally terminate the contract in justified cases in the event of inappropriate conduct by the buyer.

7.4. [Webshop Ltd.] liability does not extend to

Misuse caused by the user’s own negligence (e.g. disclosing a password to a third party); no financial or moral liability is accepted for such cases.

WARRANTY AND COMPLAINTS

We provide a statutory warranty on the quality of our products.

If a product is proven to be defective, [Webshop Ltd.] will naturally offer a refund or exchange guarantee, which includes reimbursement of shipping costs or free dispatch of a new product.

The customer is entitled to submit complaints and observations in writing to the seller. The seller is obliged to investigate the complaint within 3 days and notify the customer in writing of the outcome and any further steps to be taken.

In the event of a dispute, the consumer may refer the matter to a conciliation body. The competent conciliation body for [Webshop Ltd.] based on its registered address:
